The National Resistance Movement (NRM) has secured the Nakawa Division II directly elected councillor seat after the Chief Magistrate’s Court at Nakawa nullified the election of National Unity Platform (NUP) candidate Godfrey Luyombya and declared his rival, Emmanuel Kitosi, the rightful winner.
In a judgment delivered on October 29, 2026, Chief Magistrate Adoko Joe Fay ruled that Kitosi had presented sufficient evidence to prove that electoral irregularities substantially affected the outcome of the January 22, 2026 election.
The court found that Kitosi had not only established non-compliance with electoral requirements but had also provided numerical evidence demonstrating that he should have been declared the winner instead of Luyombya.
Consequently, the magistrate nullified the Electoral Commission’s declaration of Luyombya as the winner and ordered him to immediately vacate the councillor’s office.
The Electoral Commission was also directed to gazette Kitosi as the duly elected directly elected councillor for Nakawa Division II, Kampala District, with immediate effect.
“The petition succeeds in favour of the petitioner,” the judgment reads.
The court further awarded Kitosi costs of the petition against the respondents, including Luyombya and the Electoral Commission.
The judgment was delivered electronically through the Electronic Court Case Management Information System (ECCMIS), with the parties notified through their respective accounts.
The ruling hands the NRM a victory in the disputed electoral race, overturning the Electoral Commission’s earlier declaration of NUP’s Luyombya as the winner and paving the way for Kitosi to assume the councillor’s seat.
