The Electoral Commission has said it will not appeal High Court’s decision to kick Kawempe North MP, lawyer Elias Nalukoola of parliament.
High Court;s Justice Bernard Bemanya on Monday afternoon ordered fresh polls in Kawempe North after ruling that there was disenfranchisement of 16,640 voters in Kawempe North including Nambi Faridah which affected the outcome of the results.
The judge also ruled that Nalukoola campaigned on election day at one of the polling stations which was against election rules.
However, commenting about the court decision, the head of litigation at the Electoral Commission Eric Sabiiti said they will not appeal against the court’s decision.
“When you consider evidence that the declared candidate campaigned on the polling day, moreover at a polling station, that ground is enough to nullify the election. We have therefore taken a decision that we shall not be appealing this decision,” Sabiiti said.
“We welcome and appreciate the decision of the court. We are ready to hold the by-election.”
In law, the Electoral Commission is supposed to organize fresh elections in 60 days, however, Nalukoola’s lawyers have since filed a notice to show they are going to appeal against the decision in the Court of Appeal.
It remains to be seen what the outcome of the Court of Appeal will be.
