The Commercial Court in Kampala has ordered car dealer Yassah Matovu Sseguya to refund Shs300 million to prominent businessman Hajji Mutaasa Kafeero after a botched luxury vehicle deal involving a misrepresented Range Rover.
Court documents show that on February 1, 2024, Mutaasa entered into an agreement with Sseguya to purchase a 2023 model Range Rover valued at Shs900 million, payable in installments. Mutaasa paid an initial deposit of Shs300 million, with the remaining Shs600 million to be settled in 12 equal installments of Shs50 million.
However, after making the first installment on February 29, Mutaasa discovered that the vehicle supplied — registration number UBQ 436E — was a 2022 model, contrary to their agreement. He rejected the car and demanded a full refund. While Sseguya returned Shs50 million, he claimed the deposit was non-refundable.
Represented by Muwema & Company Advocates and Solicitors, Mutaasa took the matter to court. In her judgment, Lady Justice Susan Abinyo ruled that the car supplied was not as described in the original sale agreement, noting that the parties later entered a mutual agreement for Sseguya to either source the correct 2023 model or refund the money — a commitment he failed to honor.
“When the defendant supplied a 2022 Range Rover, which the plaintiff rejected, and subsequently agreed to either find the correct model or refund the payment, it was clear that the vehicle did not correspond with the description in the February 1, 2024 agreement,” Justice Abinyo stated.
The court declared the contract repudiated and ordered Sseguya to refund the Shs300 million to Mutaasa Kafeero, emphasizing the dealer’s failure to meet his contractual obligations.
