The High Court in Kampala has denied People’s Freedom for Front leader, Erias Lukwago bail again.

This was Lukwago’s second attempt at bail after the chief magistrates court in Makindye had earlier trashed his application.

In a ruling by Judge David Matovu on Thursday, the court said whereas Lukwago has a fixed place of abode, substantial sureties and is not a freight risk, he couldn’t be granted bail.

“Court finds that the applicant meets most of the requirements to be admitted on bail save for the lack of medical documents certified by the medical officer at the prison where the applicant is held confirming that the prison medical services are not capable of treating the applicant,” Judge Matovu said.

In his bail application, Lukwago asked court to allow him temporary freedom so he could get specialised treatment from India which he said couldn’t be provided in Uganda.

However, in his ruling, Judge Matovu said Lukwago has not proved his medical condition cant be treated locally.

“Court finds that the applicant meets most of the requirements to be admitted on bail save for the lack of medical documents certified by the medical officer at the prison where the applicant is held confirming that the prison medical services are not capable of treating the applicant.”

“Considering the fact that the report from Mulago Hospital emanated from the orders of the Chief Magistrate who actually received the said report but she has since ceased having jurisdiction in this matter, court is of the view that the applicant should forward his medical documents from Mulago hospital  to the prison authorities to ensure that they cater for his unique health and in the event that they are unable to manage his condition the prison authorities should make an appropriate report to this effect.”

The judge said he was convinced with the prosecution’s argument that Lukwago ought to have his medical report certified by medical officer of the prison .

He however directed the court’s deputy registrar to follow up on Lukwago’s committal paper from the Makindye Chief Magistrates Court to ensure the case is allocated to a judge for hearing to begin.

Lukwago is accused of committing misprision of treason for failure to report an alleged plot to overthrow the Government of Uganda by force of arms.
