Vipers ordered to pay ex-coach shs308.3m for wrongful dismissal

Uganda Premier League table leaders, Vipers Sports Club have been ordered to pay former coach, Roberto Luiz Bianchi Pelliser alias Beto Bianchi  up to shs308.3 million for wrongful dismissal.

Bianchi was sacked in March 2023 after only two months in which he played seven games.

He would later refer his case to the Court of Arbitration for Sports which in its judgment reasoned with the coach that he was wrongly dismissed .

The court ruled that whereas the two parties had entered into agreement for a fixed term contract, Vipers breached it by sacking the coach before expiry .

It therefore ruled that the coach is entitled to compensation.

“The amount of this compensation is equal to the salary and other statutory or contractual advantages that the employee would have received had notice been given in compliance with the statutory or contractual notice period (as applicable), minus all cost savings and income earned (or intentionally renounced) by the employee due to the end of the employment relationship,” the court ruled.

“Moreover, the employee is entitled to an additional indemnity, the amount of which the court can freely decide on according to all circumstances of the case. This indemnity can however not exceed an amount corresponding to six monthly salaries.”

The court said  the coach was dismissed without being given prior notice as is required by law.

“The  coach was not aware of the dismissal until the day he received the termination letter. Thus, in the absence of notice period, warning letters and a disciplinary hearing, the early termination was rather harsh and conducted in an improper manner.”

The court therefore ordered that Vipers pays USD 84,000 to their former coach, Roberto Luiz Bianchi Pelliser alias Beto Bianchi  in compensation for wrongful termination of his contract.
