A man has threatened to sue Fraine Supermarket’s Ntinda branch for selling  a wrong Valentine’s Day gift.

Through  his lawyers of Mukiibi, Nakitende and Company Advocates, Augustine Kyoobe says that on valentine’s  day, he bought a gift hamper for his wife from the supermarket which was already packed and paid shs140,100.

He noted that on reaching home, without opening, he presented the gift hamper to his wife to wish her a happy Valentine’s Day.

“..she opened it with a lot of love and excitement. To her dismay, and to our client’s surprise, she found a message card scribbled with love words (a love note) that our client had no knowledge of,” the lawyers of Mukiibi, Nakitende and Company Advocates said in the letter of intention to sue.

The gift hamper had a note with words, “I fell in love with you because of the small things you don’t even realise you are doing”.

The note was signed off by ‘Jojo’

The lawyers say on opening the gift hamper and seeing the note, Kyoobe’s wife was so much angered and decided to break up with him.

According to the lawyers, when her wife opened the gift hamper and found this love note, she was angered .

“This  greatly angered our client’s wife, who accused our client of cheating on her, and despite several explanations from our client that he simply bought the hamper from your supermarket, she packed her clothes and walked out of their matrimonial home, visibly angered, heartbroken, in tears, and leaving behind our client in the night to tender to an eight month old baby and five year old child.”

The lawyers say this was an of negligence by the  supermarket and its staff that has caused emotional damage to the family.

“This grossly negligent and obnoxious act by the staff of your supermarket has terribly broken our client’s home and family, causing him and his wife emotional damage and mental anguish, not to speak of the psychological torture caused to their two little children witnessing their mother walk out on them, terribly heartbroken and in tears.”

“We thus write to demand that you issue a written apology to our client and his wife in a newspaper of wide national circulation, apologizing for the gross negligent actions of your staff. We further demand that you pay our client shs5 million for the mental turmoil and emotional anguish caused to his entire family, plus the financial burden/ cost he is incurring by dropping off his eight month old baby in day care effective today until his wife agrees to return home, since he has to report to work in order to keep providing for his family.”

The lawyers say these demands should be met within seven working days and failure to do so would see them drag Fraine Supermarket to court for damages.
